Defendant found guilty of robbing Overlea CVS while on parole for Baltimore County murder case

BALTIMORE, MD—A man has been convicted on robbery charges while he was on parole for a Baltimore County murder case.

On Thursday, March 2, a jury found Kelly Franklin guilty of three counts of robbery from events that occurred on September 16, 2021.

Last month, Franklin was convicted of motor vehicle theft in relation to a carjacking from the night before the robbery on September 15, 2021. Franklin faces a maximum penalty of 45 years for the robberies and five years for the carjacking. He also faces approximately 16 years in prison for violating his parole in a Baltimore County homicide. Assistant State’s Attorney Brent Weinberg prosecuted these cases.

“This repeat offender was wreaking havoc in our community with no regard for the law,” said Deputy State’s Attorney Thomas M. Donnelly. “I applaud ASA Weinberg for these skillful prosecutions that have resulted in the defendant facing steep and necessary penalties for his reckless actions. It is quite evident he should not be free to do this in our communities, and this conviction will ensure that he is no longer a threat to our city.”

On September 16, 2021, the CVS store at 6635 Belair Road in Overlea (21206) reported a robbery. Several store clerks and pharmacy employees were forced to fill a trash bag up to the brim with prescription medications and a smaller bag with cash from the register. A Baltimore Police Department officer arrived on the scene and observed a man, later identified as Kelly Franklin, running from the CVS store.

Franklin dropped the bags and was quickly apprehended in a yard across the street. The investigation determined that Franklin was on active parole for a 2006 Baltimore County homicide case after serving over 13 years in prison.

The night before the CVS robbery, on September 15, 2021, a woman was threatened by Franklin to give up her vehicle, which he then proceeded to steal. Franklin’s belongings were later found in the stolen vehicle at the scene of the CVS robbery the next day. He had dropped the bags of money and medication next to the stolen vehicle, and several forms of his identification were found inside it.

Franklin is scheduled to be sentenced for the motor vehicle theft on May 8, 2023, and the robbery charges on June 13, 2023.
